Welcome to Photo Magnet UK. In these Terms & Conditions, the words “we”, “us” and “our” refer to Photo Magnet UK.

We operate this website and online store to sell personalised photo magnets and related products and services. Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

These Terms & Conditions apply to your use of our website and to any order you place with us.

By using our website or placing an order, you agree to be bound by these Terms & Conditions and our Privacy Policy.

2. Who can use this website

By using this website, you confirm that:

You are at least 18 years old, or you are using the website with the permission and supervision of a parent or legal guardian.

You agree that any information you provide to us is accurate, complete and up to date.

3. Our products

We sell personalised, made-to-order products. This means each order may be produced using photographs, artwork, text or other content uploaded or provided by you.

We make every effort to display our products as accurately as possible. However:

Colours may vary slightly depending on your device screen and settings.

Cropping and print positioning may vary slightly.

Finished products may differ slightly from on-screen previews.

The final quality of the product will depend in part on the quality, resolution and composition of the images you upload.

All product descriptions, prices, packaging and availability may be updated by us at any time.

4. Your uploaded photos and content

When you upload or send us any photograph, image, artwork, text or other material, you confirm that:

You own it, or you have permission to use it.

Its use by us to fulfil your order will not infringe anyone else’s rights.

You have permission from any identifiable people shown in the images where required.

It does not contain unlawful, abusive, defamatory, obscene or otherwise inappropriate material.

It does not breach any copyright, trade mark, privacy or other legal rights of any third party.

You grant us a limited licence to use the content you upload solely for the purposes of:

Processing your order.

Producing your personalised product.

Providing customer support in relation to that order.

Checking product quality where needed.

Dealing with reprints, complaints, refunds, quality checks or disputes related to that order.

We do not claim ownership of your uploaded images.

We reserve the right to refuse or cancel an order if we reasonably believe uploaded content:

Infringes another person’s rights.

Is unlawful or offensive.

Is technically unsuitable for production.

Creates a risk to us, our staff, our suppliers or our platform providers.

5. Customer photo consent and marketing use

We will not use your uploaded personal photos, finished magnets, order images or personal content for public marketing, social media, website content or advertising unless you have given us permission.

This permission may be given by ticking an optional consent box on the product page, at checkout, or by agreeing separately in writing.

You do not need to give this permission to place an order.

If you do not give permission, your uploaded images will only be used to create and manage your order.

We will stop using the image in future marketing where reasonably possible. However, we may not be able to remove content that has already been shared, reposted, saved, copied or published by others.

6. Image quality and customer responsibility

You are responsible for reviewing your uploaded images and order details before placing your order.

You acknowledge that:

Low-resolution, blurry, dark, heavily cropped or poor-quality images may affect the final printed result.

We are not responsible for dissatisfaction caused solely by poor-quality source images provided by you.

Small variations in colour, brightness, contrast and cropping are normal in printed personalised products.

Where practical, we may contact you if we believe an image may produce a poor result, but we are not obliged to do so before production starts.

Please check your uploaded images carefully before submitting your order.

7. Orders

When you place an order, you are making an offer to buy products from us.

Your order is only accepted when we confirm it. We reserve the right to refuse or cancel any order, including where:

The product is unavailable.

Payment cannot be authorised.

Pricing or description errors have occurred.

We suspect fraud or misuse.

The uploaded content breaches these Terms.

Please check your order carefully before submitting it. Because our products are personalised and production may begin quickly, we may not be able to change or cancel your order once it has been placed.

If we cancel an order after payment has been taken, we will refund the amount paid.

8. Prices and payment

All prices shown on our website are in GBP (£) unless otherwise stated.

For international customers, prices may be displayed in a local currency depending on your location and Shopify’s currency settings. Any currency conversion shown is provided through Shopify or our payment provider.

We take reasonable care to ensure prices are correct, but errors may occasionally occur. If we discover an obvious pricing error, we may contact you and give you the option to confirm the order at the correct price or cancel it.

Payment must be received in full before we begin processing your order.

You confirm that:

The payment details you provide are valid and authorised.

You are entitled to use the payment method provided.

All billing information you provide is accurate.

9. Personalised items and cancellation rights

Because our products are made to your specification or clearly personalised, the usual 14-day cancellation right for distance sales does not apply once your order has entered production. This is a recognised exception under the Consumer Contracts Regulations for personalised goods.

If you need to change or cancel an order, please contact us immediately. We may be able to help before production starts, but we cannot promise this.

Your rights relating to faulty, damaged or misdescribed goods are not affected.

In summary:

Personalised items are generally non-returnable unless faulty, damaged or incorrect.

If your order arrives damaged, faulty or incorrect, please contact us as soon as possible and provide your order number and clear photographs of the issue.

Where appropriate, we may offer a replacement, repair, partial refund or full refund.

Nothing in these Terms limits your statutory rights under UK consumer law.

11. Shipping and delivery

We currently offer shipping to the United Kingdom, Europe and selected international destinations.

Shipping rates are shown at checkout before you complete your order.

Current shipping options may include:

We aim to dispatch orders within the times shown on our website, but dispatch and delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by:

Postal or courier services.

Customs checks or import procedures.

Weather events.

Strikes or postal disruption.

Supply interruptions.

Events outside our reasonable control.

Risk in the goods passes to you on delivery.

If an order is returned to us because of an incorrect address supplied by you, failed delivery attempts, non-collection, unpaid customs charges, or refusal to accept delivery, we may charge for redelivery.

12. International orders, customs and duties

For orders delivered outside the UK, you are responsible for any import taxes, customs duties, handling fees, local taxes, or other charges applied by your country.

These charges are not included in our product prices or shipping fees unless clearly stated at checkout.

We are not responsible for delays caused by customs checks, unpaid customs charges, local postal delays, or import procedures.

If an international order is returned to us because customs charges were not paid, delivery was refused, or the parcel could not be delivered due to an incorrect or incomplete address, we may deduct the original shipping cost and any return costs from any refund due.

13. Business use and resale

Our website and products are intended for consumer and personal use unless we agree otherwise in writing.

You must not buy our products for resale, commercial redistribution or export without our prior written permission.

14. Intellectual property

All content on this website, including our branding, logos, text, graphics, product descriptions, images, layouts and design, is owned by or licensed to us and is protected by intellectual property laws.

You may use this website for personal, non-commercial use only. You must not copy, reproduce, modify, distribute, republish, scrape or exploit any part of the website or its content without our prior written permission.

All third-party trade marks, logos and brand names remain the property of their respective owners.

15. Reviews and feedback

If you submit a review, testimonial, comment or other feedback to us, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content for our business purposes, including on our website, social media and marketing materials.

This does not affect your ownership of your content.

This section applies to reviews, testimonials, comments and feedback you provide to us. It does not automatically give us permission to use your uploaded personal photos for public marketing. Customer photo use is covered separately under the “Customer photo consent and marketing use” section above.

We reserve the right to remove reviews or feedback that are unlawful, abusive, misleading, defamatory, infringing or spam.

16. Website use and prohibited conduct

You agree not to use our website:

For any unlawful purpose.

To upload malicious code, viruses or harmful material.

To infringe the rights of others.

To interfere with the security, performance or operation of the website.

To attempt unauthorised access to systems or data.

To use automated scraping, bots or similar tools without our written permission.

To submit false, misleading or fraudulent information.

We may suspend or block access to the website where we reasonably believe these Terms have been breached.

17. Third-party services and Shopify

Our store is hosted by Shopify. Some functions on our website may also involve third-party tools, apps or services.

We are not responsible for the content, policies or operation of third-party websites, services or tools that are not under our control.

Any purchase you make through our store is made with Photo Magnet UK, not with Shopify. To the extent permitted by law, Shopify is not responsible for the sale of our products to you. Shopify’s role is to provide the ecommerce platform.

Where relevant, Shopify also processes certain personal data in order to provide and operate the store platform. Our Privacy Policy explains this in more detail.

19. Accuracy of website information

We try to ensure all information on our website is accurate and up to date. However, we do not guarantee that all descriptions, images, pricing, stock information or other content will always be error-free, complete or current.

We reserve the right to correct errors, inaccuracies or omissions and to update information or cancel orders where necessary.

20. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

Death or personal injury caused by negligence.

Fraud or fraudulent misrepresentation.

Breach of your statutory consumer rights.

Subject to the above, and to the maximum extent permitted by law:

We are not liable for indirect or consequential losses.

We are not liable for loss of profit, loss of revenue, loss of business or loss of opportunity.

Our total liability to you in relation to any order will not exceed the amount you paid for the relevant product.

Consumer contract terms must be fair and transparent, so any limitation of liability is intended to apply only to the extent legally permitted.

21. Events outside our control

We are not responsible for failure or delay in performing our obligations where this is caused by events outside our reasonable control, including courier disruption, industrial disputes, internet outages, extreme weather, fire, flood, pandemic-related disruption, customs delays or supplier failure.

22. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in full force and effect.

23. Waiver

If we delay or fail to exercise any right under these Terms, that does not mean we waive that right.

24. Entire agreement

These Terms, together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and any other policies expressly referred to on our website, form the entire agreement between you and us in relation to your use of the website and any purchase from us.

25. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by the laws of England and Wales.

You and we agree that the courts of England and Wales shall have jurisdiction, except that if you live in Scotland or Northern Ireland, you may also have rights to bring proceedings in your local courts.
